Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by or collide with moving Tram car. a)Site 59th Street Bridge: Employer failed to notify the Roosevelt Island Tram at the beginning of shift that crane was in operation and five minutes prior to making a pick as stipulated in the site safety procedure dated September 10,1997.,on or about 1/27/98. Abatement Note: Among other method, one feasible and accepted method to correct this hazard is to adhere to stipulated safety procedure.
