Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to injuries/death from falling:
a)At the loading zone: Employee was exposed to possible fall injuries
while driving a lift
truck carrying tiers of products by not wearing provided required
protective equipment,
safety belts. On or about August 4, 1998.
ABATEMENT NOTE:  Among others one feasible and acceptable method to
eliminate or to
materially reduce this hazard is to ensure that the drivers wear the
provided safety belt at all
times during the fork lift truck operation. As per ASME/ANSI
B.56.1d-1992,5.3.19.
