Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by moving vehicles: a)At the intersection of McGuinness Boulevard and Calyer Street on or about 12/2/98. In a construction work area on the East side of McGuinness Boulevard. Employees were exposed to being struck by motor vehicles, in that barricades were not provided to the intersection. ABATEMENT NOTE: Among others, a feasible method to eliminate or to materially reduce this hazard is to barricade to the intersection as detailed in drawing "City of New York Department of Design and Construction, Maintenance of Traffic, Sheet 110 of 156, Contract No. HWK666W". ABATEMENT VERIFICATION IS REQUIRED FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY OF $1000.00.
