Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
The hazard of falling off of the access ladder of the Caterpillar 916
Wheel Loader.  The ladder
is used for the sole purpose of gaining access to the cab.  Employee
exposed to falling, getting
struck and run over by the rubber tires.
a)In front of the job trailer; On or about 7/23/97;  An employee observed
riding on
the side ladder of a Caterpillar 916 Wheel Loader was exposed to falls
from the
ladder of the moving Wheel Loader, and to being run over by the rubber
tires.
"Among other methods, one feasible and acceptable abatement method to
correct this
hazard is...."
1)Follow the safety precautions set forth in the owners manual, provided by
Caterpillar, of the Wheel Loader, pages 3, 5, and 9.
2)Follow the Equipment Manufacturer's Institute (EMI) recommendations for
safe
operating procedures contained in their manual, "Wheel Loader/ Tractor
Safety
Manual for Operators and Mechanics", on page 20.
3)Prohibit employees from riding on the exterior ladder of any Wheel
Loader.
4)Train employees in the hazards associated with riding ladders attached
to the sides
of Wheel Loaders.
