Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of being thrown from the seat of a counter-balanced sit down type industrial truck: Plant - The model V80D Caterpillar forklift truck (serial number 41X02728) and the model V60D Caterpillar forklift truck were not equipped with seat belts, on or about 11/15/96. Among other methods, one feasible and acceptable abatement method to correct this hazard is to maintain the equipment with seat belts and require the operator to use them.
