Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting thrown from the seat of a counter-balanced sit down type industrial truck: a.Breezeway - The retractable seatbelt on the YALE forklift truck (serial number 160119) was not used by the operator, on or about 2/19/97. b.Building 2, Shutter Department - The employer did not retrofit the Model 50 type LP maintenance department NISSAN forklift truck with operator restraint device(s) or seatbelts, on or about 2/19/97. Among other methods, one feasible and acceptable abatement method to correct this hazard is to maintain the equipment with operator restraint device(s) or seat belts, and require the operators to use them.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of uncovered pipes carrying steam or hot water for process or servicing machinery: a)Building 2, Dip Tank Area - The wing wheel "caustic soda" wash dip tank had two runs of steam piping that were not guarded or covered with heat-insulating material at the northwest area of the dip tank by the expanded metal deck, on or about 2/20/97. Among other methods, one feasible and acceptable abatement method to correct this hazard is to maintain all pipes carrying steam or hot water with a covering of heat-insulating material or otherwise properly guarded when exposed to contact and located within seven feet of the floor or working platform.
