Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling off a load: A) Cargo Vessel "ANNA L" - Employees were being lifted approximately 13 feet while standing on top of a roll of paper that was being lifted by an industrial truck with a clamp attachment, on or about 3/9/97. Among other methods, one feasible and acceptable abatement method(s) to correct this hazard: Strict enforcement of a policy prohibiting the industrial truck operator to lift personnel while standing on the load.

Under Section 17(a) of the Occupational Safety & Health Act of 1970 and Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting thrown out of the operators seat and being crushed by industrial lift truck: A) Throughout work place - Employees operating industrial trucks were not wearing seat belts. on or about 4/7/97. Marine Port Terminals, Inc. was previously cited for a violation of the Occupational Safety & Health Act or its requirement which was contained in OSHA Inspection Number 106448061, Citation Number 1, Item Number 1, issued on 10/18/95. With respect to a workplace located on Newcastle Street Brunswick, GA. 31521. The date of the final order was on or about 11/10/95 .1/10/95
