P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of getting crushed while standing or passing under the elevated portion of any lift truck, whether empty or loaded: a.Dock by the GPA Mayors Point Terminal Warehouse and the Star Evviva - The operator of the 1991 model H155XL type D counterbalanced Hyster sit-down operated lift truck number 11136 (serial number F006A05180M) left the control position of the lift truck with a two-roll stack of WEYCO Flint River Fluff pulp clamped and elevated more than six feet above the dock, on or about 9/6/97. b.Dock by the GPA Mayors Point Terminal Warehouse and the Star Evviva - Three workers entered the area under the elevated load of the 1991 model H155XL type D counterbalanced Hyster sit-down operated lift truck number 11136 (serial number F006A05180M) with a two roll stack of WEYCO Flint River Fluff pulp clamped and elevated more than six feet above the dock, on or about 9/6/97. c.Dock by the GPA Mayors Point Terminal Warehouse and the Star Evviva - The 1991 model H155XL type D counterbalanced Hyster sit-down operated lift truck number 11136 (serial number F006A05180M) equipped with the model NSQ11NST3451N16ENO Long Reach Manufacturing Company twin pack paper roll clamp number 72381 (serial number C273061) had two rolls of WEYCO Flint River Fluff pulp stacked one on the other with the top roll completely in the clamp but the lower roll partially in the clamp with approximately 16 to 17 inches below the clamp pads, on or about 9/6/97. Among other methods, one feasible and acceptable abatement method to correct this hazard is to lower the load-engaging means fully before leaving the operator's position and do not allow anyone to stand or pass under the elevated portion of any truck, whether full or loaded in accordance with ANSI B56.1-1993 Sections 5.2.7 and 5.2.11 Operating Safety Rules and Practices; and extra care must be taken in securing, manipulating, positioning, and transporting the load in accordance with ANSI B56.1-1993 Section 5.4.2 Operating Safety Rules and Practices.
