P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard(s) of falling from an elevated
platform:
a)  At the construction site - Employees were exposed to fall hazards.  A
forklift tractor with
an unapproved platform was used for lifting personnel to perform work,
access and/or egress
higher elevations, on or about 12/03/98.
b)  At the construction site - An employee operating a Berridge Zee Lock
panel machine from
an elevated forklift, was not provided with fall protection, on or about
12/03/98.
Among other methods, one feasible and acceptable abatement method to
correct the hazard is:
1.  Provide an approved platform designed for this purpose, securely
attached to the forks.  Use
alternate methods for access/egress higher elevations, i.e. scaffolds,
ladders.
2.  Provide a personal fall arrest system to employees operating the panel
machine.
