P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of: a)Production Area & Yard - Employee observed operating a Daewood industrial forklift, Model #G25S2, SN 1284204, was not wearing the installed seat belts, thereby exposing the employee to struck-by/crush-by hazards should the forklift accidently tip over and cause fatal upper body injuries if thrown out of the operator's seat, on or about 2-2-99.r's
