P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown out of operators seat: A) Warehouse and loading dock area - An employee was operating a Clark industrial forklift truck without wearing the seatbelts that were provided. this was exposing the operator to struck- by/crushed-by hazards, should the forklift be accidently tipped over, that could result in fatal injuries when their upper body parts were struck/crushed by the lift truck overhead protection device as they were thrown out of the operator seat, on or about 9/20/99. Other feasible and acceptable abatement methods to correct this hazard would be to ensure that employees wear seatbelts while operating industrial trucks.
