P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard(s) of being thrown from forklifts
and/or overturns during
forklift operations:
a)  At the delivery site and/or at the company worksite -  Employees were
exposed to crushing
by heavy equipment while utilizing rough terrain forklift trucks without
the use of seatbelts, on
or about 06/23/00.
Among other, feasible and acceptable abatement methods to correct this
hazard include:
1.  Instruct employees that the use of seatbelts while operating this
equipment is mandatory.
2.  Provide supervision to ensure use of the safety equipment.
3.  Follow all manufacturer's operating/training instructions as per the
operator's
manual.

29 CFR 1910.178(l)(1)(i):  The employer did not ensure that each powered
industrial truck
operator was competent to operate a powered industrial truck safety, as
demonstrated by the
successful completion of the training and evaluation specified in this
paragraph:
a)  At the delivery site and/or at the company worksite -  Employees were
exposed to tip over
and crushing by heavy equipment hazards while operating a rough terrain
forklift truck laterally
on an inclined surface, on or about 06/23/00.
b)  At the delivery site and/or at the company worksite - Employees were
exposed to tip over
and crushing by heavy equipment hazards while operating several types of
forklift trucks without
receiving training on the proper operation of this equipment, on or about
06/23/00.
OR IN THE ALTERNATIVE:
P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of

and crushing by heavy equipment hazards while operating several types of
forklift trucks without
receiving training on the proper operation of this equipment, on or about
06/23/00.
Among other, feasible and acceptable abatement methods to correct this
hazard include:
1.  Prohibit the practice of operating a 3 wheeled forklift laterally on
inclined surfaces.
2.  Provide training, both classroom and hands-on, to employees before
they use the equipment.
3.  Follow all manufacturer's operating/training instructions as per the
operator's manual.
