Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being crushed by and thrown out of materials handling equipment: a.At the Drystack Area, Puerto del Rey Marina & Resort. An employee was observed, two others documented, operating a Taylor TSE-90M forklift without wearing seat belts. Among other methods, one feasible and acceptable method to correct this hazard is to: Require and enforce the use of seat belts as required by the forklifts manufacturer's safety manual. NOTE:Certification and documentation of abatement must be submitted for this citation item as required by 29 CFR 1903.19.
