Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck and/or caught by/between a suspended load: a.At Villa Marina Yacht Harbour, Inc. It was documented that employees place wood blocks, to initially support a boat before towers (in the form of tripods) and/or wood wedges are also placed to support the boat. Once the boat is lowered to the blocks, if modification to the location of the blocks is merited, the employees rearrange the position of the blocks. While relocating the blocks, the boat is suspended in the air by a Travelift Marine Mobile Crane, while the employees are under the suspended load. Among others, feasible and acceptable abatement methods to correct this condition are to: 1.Properly support the load before work is begun by lowering it into a cradle. 2.Place the blocks in a preselected location to avoid the need for an employee to rearrange them. 3.Use a rod (or any other tool) to relocate (push/pull) the blocks once the load is suspended over them. NOTE:Certification and documentation of abatement must be submitted for this citation item as required by 29 CFR 1903.19.
