Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck and/or caught by transport equipment associated with the handling of intermodal containers: a.On or about 3/20/2001, at the worksite. It was observed that two intermodal containers were pre-mounted on a chassis, vertically coupled by twist locks, and transported by brutes (a.k.a. "hustlers", "capacities" and "yard tractors") from a distant loading/storage area to the apron area for a double-pick operation (tandem-lifting). In the event of the overturning of an unstable load during the transport operation, employees (equipment operator or employees in the immediate area) would be exposed to being struck or caught by the equipment. Hazard:Struck by; Caught by. Note:Documentation of abatement shall be submitted for this citation item as required by 29 CFR 1903.19(d). Among others, feasible and acceptable abatement methods to correct this condition are: 1.Allowing transportation of the vertically coupled containers by equipment designed and manufactured for such purposes; i.e. top loaders and/or straddle carriers. 2.Stopping the practice of pre-mounting (double mounting) containers on the same chassis at a distant loading area, other than allowed by the OSHA provisions for Tandem lifting (OSHA interpretation dated 09/02/1993 for 1918.85 and 1917.71 on the lifting of two empty containers that are vertically coupled by twist locks).
