Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The platform being used as an elevated work platform at the construction site at Kingsley Field in Klamath Falls, Oregon was not secured to the forklift. b) Protection for employees working on the platform was not provided to protect employees from the moving parts, such as the mast. c) The platform which measured 20 feet in length extended more than 4 feet on each side of the load bearing tires. d) Guardrails were not provided on either end of the platform in use at the construction site.ruction
