Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: Crushing hazards with the merchandise in case of a mezzanine collapse. a)Warehouse area of the workplace known as M.C. Distributors Corp. - Employees were working daily as merchandise dispatchers and walking continually underneath of a wood mezzanine of 21' large x 11'10" width which had nearly 300 boxes or more with different types of storaged merchandise on it. The weight of these boxes contributing with the deflection of the wood floor of such mezzanine. This mezzanine had some chains with thin links tied around the steel beams on the ceiling. There are not appropriate to the work that its doing which is the distribution of the weight of such merchandise and on the same time to provide a better support. For the other hand, the wood lumbers of such mezzanine located on the front, which are the main support of it were completely deteriorated with little holes and eated by moth causing weakness and inestability on them. Also these wood lumbers were deflecting due to the weight of the merchandise. Among other methods, one feasible and acceptable abatement method to correct this hazards is to place steel beams underneath of the mezzanine floor to streghtened it and to provide a better and a more safety support. Riesgos de aplastamiento con la mercancia en caso de un colapso del mesani. a)Area del almacen del lugar de trabajo conocido como M.C. Distributors Corp. - Empleados estuvieron trabajando como despachadores de mercancia y anduvieron continuamente por debajo de un mesani de 21' de largo x 11'10" de ancho el cual tenia aproximadamente 300 cajas o mas de diferentes tipos de mercancia almacenada en el. El peso de estas cajas contribuyen con la defleccion del piso de madera de dicho mesani. Este mesani tenia varias cadenas con eslabones delgados amarradas alrededor de las vigas de acero en el techo. Las mismas no son apropiadas para la funcion que estan haciendo que es la distribucion del peso de la mercancia y a la misma vez proveer un mejor apoyo. Por otro lado, los palos de madera de dicho mesani localizados en el frente, los cuales son el apoyo principal de este, estaban completamentedeteriorados con pequenos agujeros y comidos por la polilla, causando debilidad e inestabilidad sobre ellos. Tambien, estos palos de madera se estaban deflecionando debido al peso de la mercancia. Entre otros metodos, un metodo de correccion factible y aceptable para corregir este riesgo es colocar vigas de acero debajo del piso de madera del mesani para fortalecerlo y proveer un mejor y mas seguro apoyo."
