employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or physical harm to employees
in that employees
were exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
a)At the workplace known as Superdescuentos Pitusa - Employees were working
on carnage operation cutting pork, cattle and goat ribs and others types of
meats with bone, using two backsaws, Model Hobart 5801, serial number 27-
18-5940 and serial number 27-093-695, which were not used correctly.  The
employees were not trained in the correct use and secure handling of such
equipment due to the fact that they made the cut without place the ribs or
any
type of meat with bone on the machine tray located on left side of each
one.
This tray has at the backside a small lifted edge designed to be pushed
and to
protect the employees hands avoiding a direct push using his hands in the
point
of operation.  Also they did not fixed the ribs with the stainless steel
guard
located at the right side of each machine which help to make a more secure
cut.  Neither they did not let down the guard located on the saw blade
until the
level where the meat with bone or rib will be cut in such a manner every
time
that an employee made a cut a great space of the blade was unguarded.  Each
one of these machines have a tag which establish: "Warning moving blade and
pulleys, keep hands clear, do not operate without covers and guards in
place".
Some employees of this company had been suffered amputation accidents
because they did not worked and followed these safety requirements
mentioned
previosly.
Hazard:  Fingers and hands amputation in the point of operation.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is provide training to all of employees in the correct
use
and secure handling of these machines emphasizing in the continue and
obligatory use of machines guards and the tray.  Also the employer must
require them to cover the blade of each backsaw until the level where the
rib
or any meat with bone will be cut.
a)En el lugar de trabajo conocido como Superdescuentos Pitusa - Empleados
estuvieron trabajando en la operacion de carnicera cortando costillas de
cerdo,
res, cabro y otros tipos de carnes con hueso, utilizando dos sierras de
cortar
costillas, modelo Hobart 5801, numero de serie 27-18-5940 y numero de serie
27-093-695, las cuales no fueron utilizadas correctamente.  Los empleados
no
fueron adiestrados en el uso correcto y manejo seguro de dicho equipo
debido
al hecho de que hacian el corte sin colocar las costillas o cualquier tipo
decarne con hueso en la bandeja localizada en lado izquierdo de cada una
de las
maquinas.  Esta bandeja tiene en la parte posterior un pequeno borde
levantado, disenado para ser empujado por el empleado y para proteger las
manos evitando un empuje directo utilizando sus manos en el punto de
operacion.  Tambien ellos no fijaban las costillas con el resguardo de
acero
inoxidable localizado en el lado derecho de cada maquina el cual ayuda a
hacer
un corte mas seguro.  Tampoco estos bajaban el resguardo localizado en la
hoja de la sierra hasta el nivel donde la carne con hueso o costilla va a
ser
cortado de manera tal que cada vez que un empleado hacia un corte un gran
espacio de la hoja quedaba sin resguardo.  Cada una de esas maquinas tienen
una etiqueta que dice: "cuidado hoja y poleas en movimiento, mantenga las
manos alejadas, no opere sin tener los cubridores y resguardos en su
lugar".
Varios de los empleados de esta compania han sufrido accidentes de
amputacion porque estos no trabajaron, ni siguieron estos requisitos de
seguridad mencionados anteriormente.
Riesgo:  Amputacion de dedos y manos en el punto de operacion.
Entre otro metodos, un metodo de correccion factible y aceptable para
corregir
este riesgo es proveer adiestramiento a todos los empleados en el uso
correcto
y manejo seguro de estas maquinas enfatizando en el uso continuo y
obligatorio de los resguardos y de la bandeja.  Tambien el patrono debe
requerirles el cubrir la hoja de cada sierra hasta el nivel donde la
costilla o
cualquier otro tipo de carne con hueso va ser cortada."
