Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a) West End, Interior Side of Building - On or about October 8, 1997, two
employees were
exposed to the hazard of falling approximately 16 feet to the ground below
while standing on
the midrail of the guardrail system on the Marklift self propelled
elevating work platform
(scissor lift).
Among other methods, one feasible and useful method to correct this hazard
is to develop.
implement, and enforce a work rule such as stipulated in American National
Standards Institute
A92.6 " American National Standard For Self Propelled Elevating Work
Platforms" 1990.
Personnel shall maintain firm footing on the platform while working
thereon.  Use of planks,
ladders or any other device on the aerial platform for achieving
additional height or reach shall
be prohibited.
