Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to:
(a) The employer had in use motor vehicle equipment having an
obstructed view to the rear which did not have a reverse signal
alarm audible above the surounding noise level or an observer
signaling it was safe to operate the vehicle in reverse: The
vehicles were a Grove crane, a Barco front end loader and a Terex
dump truck (Jett construction equipment), exposing employees to the
hazard of being struck by the vehicles.
"Among other methods, one feasible and acceptable abaatement method
to correct this hazard is to repair the back up alarms".
