Section 5(a)(1) of the Occupational Safety and Health Act of 1970: : The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) 1617 28th Ave South, Homewood Al. On or about 5/18/98 employees were exposed to the hazard of being struck by pieces of a tree while working at and around the bottom of a tree during tree removal operations. Among other methods, one means of correction of this hazard is to develop and implement safe work procedures as detailed in American National Standards Instuite, ANSI Z133.1-1988 Almerican Natiional Standard for tree care operations; "Pruning, trimming, repairing, maintaining, and removing trees, and cutting brush safety requirements". Paragraph 8.5 "felling". Paragraph 8.5.3 "all workers not directly involved in an operation shall be kept clear of the work area".
