Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling out of the vehicle cab and being crushed. (a) Approximately one and one half miles off of Flat Top road near Graysville Al. On or about 6/30/98 an employee was operating a Korem Pre-hauler over rough terrain without the use of a seat belt. Among other means, one method to correct this hazard is to provide functional seat belts and insure there use.e
