Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were allowed to consume acholic beverages (beer) while working at the construction site: a) At the construction site, the employer did not prevent workers on the site from consuming acholic beverages in and around building 6 and 7, several empty beer bottles and cans were located near the stairway and on the upper levels of the buildings.
