Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were allowed to consume alcoholic beverages (beer) while working at the construction site: A.) AT THE JOBSITE, ON OR ABOUT 03-06-97: THE EMPLOYER DID NOT PREVENT WORKERS ON THE SITE FROM CONSUMING ALCOHOLIC BEVERAGES IN AND AROUND THE BUILDING, SEVERAL EMPTY BEER CANS WERE DISCARDED AROUND THE BUILDING. Among other methods, one feasible and acceptable abatement method to correct this hazard is to strictly enforce a zero tolerance program of no alcohol use at the jobsite.
