Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falls up to approximately 7 feet from an
unsecured and
unprotected wooden pallet on a powered industrial lift truck:
(a)Sorting area, on or about 6/16/98; an employee was raised and lowered
approximately
7 feet by a Clarklift fork truck Model #TM20, serial number
TM247-1023-909-1FB,
while standing on a wooden pallet which was held up by the truck's forks.
The pallet
was not secured to the forks and did not have guardrails.  The employee
was attempting
to remove boxes of paper cups from a stack of pallets containing the
boxes.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to use a safety platform with guardrails that is secured to the
lifting carriage
and/or forks of the truck as stipulated by ANSI B56.1-1993, Section 4.17.2
and 4.17.3,
American National Standard for Powered and Nonpowered Industrial Trucks
(Safety
Standard for Low Lift and High Lift Trucks).
