Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of falling approximately 12 feet from a pallet
supported by the forks
of a high lift truck:
On or about 8/25/98
A) Niagara Falls Blvd., Amherst, NY. An employee erecting trusses from a
pallet lifted
by a Gradall 534C Fork Lift truck at heights up to 12' above the ground.
The pallet was
not secured to the forks and fall protection was not provided.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD
TO CORRECT THIS CONDITION IS:
1) to use a safety platform secured to the lifting carriage and/or forks
as stipulated by
ANSI B56.1-1975, sections 427 and 513A, American National Standard for
Power
Industrial Trucks (lowlift and highlift trucks), and
2) provide standard guardrails around the platform to conform with
1926.502(b).
