Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)On or about 4/16/99, weld and fabrication area. Employees hand feed material into the Buffalo Ironworker which does not have a guard over the foot pedal to prevent accidental activation. ANSI B11.5-1975, paragraph 4.3.5 states "The foot control shall be protected so as to inhibit operation from falling or moving objects, or unintended operation by someone accidentally stepping on it. ABATEMENT DOCUMENTATION REQUIREDATION
