Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did
not furnish employment and a place of employment which were free from
recognized
hazards that were causing or likely to cause death or serious physical
harm to employees
in that employees were exposed to crushing hazards from equipment.
a.  Employees working in the yard area were exposed to serious injury from
being
crushed by a John Deer 644 loader which did not have an operational backup
alarm
discernable from the surrounding noise level, nor was an assistant
available that could
signal if it was safe to operate such equipment in the reverse direction.
Methods of abatement are, but not limited to:
(1)  Designate a person to be responsible to signal operator of equipment
if it is safe to
back up.
(2)  Provide such equipment with an alarm that would operate while
equipment
is
operating in the reverse direction.
b.  The front glass panels of the John Deer 644 loader were distorted in
that they were
badly cracked obscuring the vision of the driver and his ability to see
other workers,
exposing employees to striking and/or crushing hazard.
Methods of abatement are, but not limited to:
Replace glass panels with undamaged glass meeting the equipment
manufacturers
specifications.
c.  A John Deer 644 loader without adequate seating was used to transport
unrestrained
employees sitting partially inside the cab of the loader, exposing
employee to crushing
injuries.
Methods of abatement are but not limited to:
Allow the transport of only the number of employees specified by the
equipment
manufacturer.
29 CFR 1903.19(d)(1) requires certification and documentation that the
abatement of the
above violation is complete.
