Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: Employees standing on the 50" x 28" work platform to wash out wastewater tanker trailers were exposed to fall hazards of 10 feet to the concrete below. The work platform did not have guardrails, nor was equivalent means of fall protection provided. Among other methods, one feasible and acceptable abatement method to correct this hazard is: 1. Removable guardrails installed on existing work platforms on top of tank trailers, or 2. Use of mobile work platform, or 3. Work platform attached to existing structures in proximity of trailer unloading area. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete.
