Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.On January 24, 1997, employees who drive Capacity Trucks were exposed to the hazards of jumping eleven inch curbs on the ramps, while moving trailers off of The San Juan Barge. The fall resulting from jumping the curbs could be two stories in height. Among other methods, one feasible and acceptable method to correct this hazard is to raise the height of the curbs to a minimum of double their existing height, and replace the railings with a more sturdy structure on top of the curbs.ure
