Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: a.On March 11, 1997, employees were exposed to the hazard of being crushed by the dumbwaiter if an employee entered the first level hoistway while the dumbwaiter was elevated. The dumbwaiter's hoistway was not enclosed throughout its height with a fire-resistive enclosure, and all hoistway landing openings were not protected with fire-resistive door assemblies in accordance with Rule 700.1 of American National Standards Institute A17.1-1971. Among other methods, one feasible and acceptable abatement method to correct this hazard is to enclose the hoistway, throughout its height, with a fire-resistive enclosure and to install fire-resistive door assemblies at all hoistway door openings.
