Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards: a.On or about March 25, 1998, in the chimney annular shell space at the 450 foot level, the fire protection program to be followed throughout all phases of the repair to the chimney, was not implemented as required by the Fire Prevention and Protection program, exposing employees to fire hazards resulting from overhead welding operations. Among other methods, feasible and useful abatement methods for abating this hazard are: 1.Implement existing Fire Prevention and Protection program on this site which ensures the availability of firefighting equipment at all times. 2.Conspicuously locate all firefighting equipment. 3.Periodically inspect all firefighting equipment and ensure it is maintained in proper operating condition. 4.Provide a temporary or permanent water supply of sufficient volume, duration, and pressure to properly operate the firefighting equipment as soon as combustible materials accumulate. 5.Provide portable fire extinguishers for use. One-55 gallon open drum of water with two fire pails may be substituted for a fire extinguisher having a 2A rating. A 1/2 inch diameter garden-type hose line, not to exceed 100 feet in length and equipped with a nozzle, may be substituted for a 2A-rated fire extinguisher, providing it is capable of discharging a minimum of 5 gallons per minute with a minimum hose stream range of 30 feet horizontally. ABATEMENT CERTIFICATION IS REQUIRED
