Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment which was free from recognized hazards that were
causing or likely to cause
death or serious harm to employees in that employees were exposed to a
crushing hazard:
a.On or about May 6, 1998,  at the construction job site at 840 A1A North,
Ponte
Vedra Beach, FL,  a 1998 Lull Rough Terrain Forklift, Model 644B, S/N
98Z19N21-328, with a boom being used to set columns in place, was not being
operated on a route clear of obstacles which could cause it to tip-over,
exposing
employee to being crushed.
Among other methods, feasible and acceptable method to correct this hazard
is to ensure
that the operator follows the manufacturer's owner/operator manual which
requires the
operator to (1) plan the work and choose a route clear of obstacles which
could cause it
to tip-over or loose a load. (Reference ASME/ANSI B56.6 Safety Standard
for Rough
Terrain Forklift Trucks, Section 5.3 Stability).
ABATEMENT CERTIFICATION IS NOT REQUIRED
