Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: potential overexposure to ammonia in emergency situations in that the employer did not comply with the following requirements of IIAR-2 and IIAR No.109. (a)No emergency remote controls to stop the action of the compressors were located outside the RECO and D1/D2 rooms.(IIAR-2, Section 4.4.11.) There is an electrical disconnect for the RECO room, but it is inside. (b)No emergency remote ventilation controls were located just outside the RECO and D1/D2 rooms.(IIAR-2, Section 4.3.6.) (c)No emergency eye wash and shower was located just outside the RECO and D1/D2 rooms.(IIAR No.109, Section 4.10.10.) There is a shower inside the RECO room and an eye wash inside D1/D2 room. (d)No self contained breathing apparatus was located just outside the RECO and D1/D2 rooms.(IIAR No. 109, Section 4.10.11.) The company has four SCBA's but they are stored near the machine rooms.
