Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which are free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that workers were exposed to hazards of unguarded and inadequately guarded foot pedals used to activate the power presses: a) Frame Department: Guarding was not adequately provided to prevent accidental activation of the Deeghan punch press used on the 2100 series window, exposing workers to the hazard of avulsion, fractures, and lacerations. b) Frame Department: Guarding was not adequately provided to prevent accidental activation of the punch presses used on the 2300/2400 series window, exposing workers to the hazard of avulsion, fractures, and lacerations. c) Frame Department: Guarding was not provided to prevent accidental activation of the Deeghan punch press used on the 2000 series window, exposing workers to the hazard of avulsion, fractures, and lacerations. d) Sash Department: Guarding was not provided to prevent accidental activation of the punch presses used on the lock and keeper components, exposing workers to the hazard of avulsion, fractures, and lacerations.
