Military Road Bridge Renovation Project, Span Two - Section 5(a)(1) of the
Occupational
Safety and Health Act of 1970:  The employer did not furnish employment
and a place of
employment which were free from recognizable hazards that were causing or
likely to cause
death or serious physical harm to employees, in that:
a.two steel brackets that were not designed in accordance with industry
accepted
engineering practices failed under the actual applied loads.
b.the concrete anchors that secured the northern most brackets to Piers
one and two
were not properly proportioned in accordance with well accepted
engineering practices of the
industry, in that, they were not properly designed to support the load s
imposed.
c.the employer did not obtain the approval of a licensed professional
engineer before
using the components of an approved steel framing system in a manner that
was unauthorized
by the professional engineer of record.
Among other methods, one feasible and acceptable means of abatement would
be to secure
the approval of a licensed professional engineer competent in structural
design before:
a. installing the false work in a different manner and for different
purposes than
it was originally designed, and
b.secure similar approval for the steel framing and anchor bolts to ensure
they
complied with industry accepted engineering practices prior to subjecting
the false
work to loads.

Occupational
Safety and Health Act of 1970:  The employer did not furnish employment
and a place of
employment which were free from recognizable hazards that were causing or
likely to cause
death or serious physical harm to employees, in that:
a.only nine of the ten bolts used to attach the northern most bracket to
Pier one were
fully embedded per the manufacturer's specifications.
b.the contractor did not reasonably account for the questionable
structural integrity of
the concrete in the area on which the bracket was installed.
Among other methods, one feasible and acceptable means of abatement would
be to install all
ten required bolts to the specified depth and to perform an adequate
survey (other than visual
observations) to determine the structural integrity of the concrete where
the northern most
bracket was installed on Pier one.
