Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a
place of employment which were free from recognized hazards that were
causing or likely to cause death or serious
physical harm to employees in that employees were exposed to:
a. Instability of the load and potential loss of load and/or crane
collapse in that on the West side of the jobsite, the
Manitowoc C-80 land based barge mounted crawler crane was mounted on a
Mobro barge that the entire bottom area
of the barge was not completely submerged, approximately half of the hull
of the barge was submerged and the other
half was on the river bank while the crane was in use.
Among other methods, one feasible and acceptable abatement method to
correct this hazard would be to comply with
Floating Cranes and Floating Derricks ANSI B30.8-1.2.2(b)(2)(c): The
entire bottom area of the barge or pontoon
shall be submerged.
b. Land cranes mounted on barges have a maximum allowable list of 5
degrees, a list of more than 5 degrees can lead
to load instability and potential crane collapse, on the West side of the
jobsite,
the Manitowoc C-80 land based barge
mounted crawler crane was mounted on a Mobro barge and means was not
provided for the operator to visually
determine the list of the barge.
Among other methods, one feasible and acceptable abatement method to
correct this hazard would be to comply with
Floating Cranes and Floating Derricks ANSI B30.8-1.4.3(e): Means shall be
provided for the operator to visually
determine the list of the pontoon or barge.
c. Fall potential of approximately eight feet from the unstable cab roof
of the crane during inspections/lubrication of
the crane, in that the cab roof of the Manitowoc 4000 150 ton C-42 Crane
land based floating crane on the East side of
the jobsite had been made of plywood that had weathered and was no longer
capable of supporting, without permanent
distortion, the weight of a 200 lb. (90 kg.) person.
Among other methods, one feasible and acceptable abatement method to
correct this hazard would be to comply with
Floating Cranes and Floating Derricks ANSI B30.8-1.10.4: Cab Roof where
necessary for rigging or service
requirements, a ladder or steps shall be provided to give access to the
cab roof. The ladder or steps shall conform to
the requirements of ANSI/SAE J185 and shall be capable of supporting,
without permanent distortion, the weight of a
200 lb. (90 kg.) person.
d.  Instability of the load and potential loss of the load and/or crane
collapse in that the crane must be mounted on a
structurally sound and stable surface; periodic inspections shall be made
of barge compartments for leakage and
structural damage and safe access to the barge compartments was not
provided on the Mobro barge, on which the
Manitowoc C-80 land based barge mounted crawler crane was mounted, on the
West side of the jobsite, in that the
manholes were only approximately 18 1/2 inches in diameter.
Among other methods, one feasible and acceptable abatement method to
correct this hazard would be to comply with
Floating Cranes and Floating Derricks ANSI B30.8-1.3.3: Manholes shall be
no smaller than 15 in. x  22 in. (380 mm
x 560 mm). Access shall be provided to all void compartments.
e. Instability of the load and potential loss of the load and/or crane
collapse
in that the crane must be mounted on a
structurally sound and stable surface in that complete periodic
inspections were not performed on barges that included
inspecting compartments for leakage and structural damage on the Mobro
barge, on which the Manitowoc C-80 land
based crawler crane was mounted, on the West side of the jobsite.
Among other methods, one feasible and acceptable abatement method to
correct this hazard would be to comply with
Floating Cranes and Floating Derricks ANSI B30.8-2.1.3(b)(2) Periodic
complete inspections shall be performed on
barge or pontoon compartments for leakage and structural damage; void
compartment atmosphere shall be testedbefore entering.
f. Instability of the load and potential loss of the load and/or
boom/collapse in that on the West side of the jobsite, on
the boom of the Manitowoc C-80 land based barge mounted crawler crane,
mounted to the Mobro barge, lattices were
swollen with rust, excessively corroded, and/or bent, some of the lattices
had been marked with red flagging, and had
not been repaired before the operation of the crane was resumed in that:
i) On the head section of the boom, the top lattice towards the sheaves,
the
left weld was bubbled with rust and
corroded all the way around the lattice.
ii) On the head section on the left side, the fourth lattice back from the
tip end, behind the "C" in the
Manitowoc sign, was swollen and disfigured with rust. The paint on the
lattice was blistered with corrosion
underneath the paint. The bottom weld on the lattice was excessively
corroded with rust. This lattice was not
uniform with the other lattices in the head section of the boom.
iii) The first cross bracing from the tip end, both lattices were
excessively corroded and swollen with rust and
had blistered paint.
iv)  The second cross bracing from the tip end on the back side the
lattice from left (top) to right (bottom) was
excessively corroded and swollen with rust and disfigured.
v) The second section from the tip end the first angle lattice was bent on
the bottom.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard would be to comply with
Floating Cranes and Floating Derricks ANSI B30.8-2.3.3(c)(2): Repairs or
replacements shall be provided as needed
for operations for critical parts of the structure which are cracked bent,
broken or excessively corroded.
g. Instability and/or loss of the load in that the capacity in tons and
weight of the Crosby hook on the Manitowoc C-80
land based barge mounted crawler crane located on the Mobro barge on the
west side of the jobsite, was corroded with
rust and was not discernable.
Among other methods, one feasible and acceptable abatement method to
correct this hazard would be to comply with
Floating Cranes and Floating Derricks ANSI B30.8-1.9.6 All hook and ball
assemblies and load blocks shall be labeled
with their rated capacity and weight.
h. No warning of brake failure due to the air pressure alarm for the
brakes in the cab had been disarmed/covered over
on the Manitowoc C-80 land based barge mounted crawler crane on the Mobro
barge on the west side of the jobsite.
Among other methods, one feasible and acceptable abatement method to
correct this hazard would be to comply with
Floating Cranes and Floating Derricks ANSI B30.8-2.1.2(a) and 8-2.3.3
items such as all safety devices for proper
function shall be inspected at intervals (frequent inspections) as defined
in para. 8-2.1.1(b)(1), or as specifically
indicated, including observation during operation for any deficiencies
which might appear between regular inspections
and any hazardous conditions disclosed by the inspection requirements of
para. 8-2.1 shall be corrected before
operation is resumed.
i. Instability of the load due to improper reeving of the rope on the drum
for the whip line on the Manitowoc C-80 land
based barge mounted crawler crane on the Mobro barge on the west side of
the jobsite.
Among other methods, one feasible and acceptable abatement method to
correct this hazard would be to comply with
Floating Cranes and Floating Derricks ANSI B30.8-2.1.2(a) and 8-2.3.3
items such as rope reeving for compliance
with crane or derrick manufacturer's recommendations shall be inspected at
intervals (frequent inspections) as definedin para. 8-2.1.1(b)(1), or as
specifically
indicated, including observation during operation for any deficiencies
which
might appear between regular inspections and any hazardous conditions
disclosed by the inspection requirements of
para. 8-2.1 shall be corrected before operation is resumed.
j. Damage to wire rope and instability of the load due to sheaves on the
block were not smooth in that were worn and
grooved from wear on the Manitowoc C-80 land based barge mounted crawler
crane on the Mobro barge on the west
side of the jobsite.
Among other methods, one feasible and acceptable abatement method to
correct this hazard would be to comply with
Floating Cranes and Floating Derricks ANSI B30.8-1.9.4(a) Sheave grooves
shall be smooth and free from surface
defects which could cause rope damage.
k. Loss of load, in that the latch was missing of the ball hook on the
Manitowoc 4000 150 ton C-42 land based floating
crane on the east side of the jobsite.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard would be to comply with
Floating Cranes and Floating Derricks ANSI B30.8-1.9.6  Hooks shall be
equipped with latches unless the application
makes the use of a latch impractical.
l. Loss of load and/or instability of load, in that modified ratings due
increased loading from environmental conditions
such as list, trim, wind and wave action were not obtained from the
manufacturer for land cranes mounted on barges
for the Manitowoc C-42 land based crane mounted on the 10/40 sectional
barge and the Manitowoc C-80 land based
crawler crane mounted on the Mobro barge.
Among other methods, one feasible and acceptable abatement method to
correct this hazard would be to comply with
Floating Cranes and Floating Derricks ANSI B30.8-1.2.2(b)(2)(a) Barge- or
pontoon-mounted land cranes require
modified ratings due to increased loading from list, trim, wave action,
and wind. This rating will be different for each
size of pontoon or barge used. Therefore, the load rating of barge- or
pontoon-mounted land cranes and derricks shall
not exceed that recommended by the manufacturer or qualified person for
the particular barge or pontoon under the
