Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to crushing injuries from a forklift overturning or
having fallen off
the forklift, due to the fact that the operator restraint systems, (seat
belts) provided on the
forklift were not used by the operator. Among other methods, one feasible
and acceptable
method to correct this hazard is to require and effectively enforce the
use of the operator
restraint systems provided  by the manufacturer of the forklift.
a)  At the worksite, an employee operating a Terex Handler model SS 636,
serial number
991847, was observed not wearing the seat belt provided.
