Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of silicosis disease: (a)At the Federal Correctional Facility construction site, Bennettsville, SC, where masonry saw operators were exposed to excessive levels of airborne silica, capable of promoting silicosis disease. Medical surveillance was not conducted for masonry saw operators. Among other methods, one feasible and acceptable abatement method would be the development of a medical surveillance program including medical history, and x-ray and pulmonary function tests every 2-5 years depending on exposure as outlined in Appendix C of OSHA's memorandum regarding a special emphasis on silicosis (May 2, 1996).
