Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries from an excavator overturning or from the operator falling from the excavator, due to the fact that the operator restraint systems (seat belts) provided on the excavator were not used by the operator. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to require and to effectively enforce the use of the operator restraint systems provided by the manufacturer of the excavator. a) At the worksite, an employee operating a Komatsu PC 60 excavator, did not wear the seat belt provided.,
