Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees, in that,
employees were exposed to the hazard of crushing injuries while operating
the Case 9060
Excavator.
On 3/5/97, an employee was operating the Case 9060 Excavator when another
employee was struck by the bucket and thrown into an adjacent piece of
equipment.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to instruct each employee that operates the Case 9060 Excavator in the
following
procedures:
a.  Give instructions to the operator on safe and correct use of the
machine.
b.  Make sure the operator reads and understands the operators manual for
this
machine.
c.  Ensure that the operator lowers the bucket or tool to the ground,
stops the
engine and rotates the left Control Console up before leaving the operators
seat.tors
