Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the serious and recognized hazard(s) associated with a lack of operator restraint sytems on powered industrial truck(s): (a)Poma of America, Grand Junction, CO: On or before 08-05-97, the employer did not require operators of powered industrial trucks to utilize seat belts while operating the equipment. In addition, powered industrial trucks lacking operator restraint systems were not repaired or retro-fitted to ensure that the operator would be safely restrained during a tipover, rollover, or other operational emergency. One feasible method of abatement, among others, is to outfit, maintain, and operate powered industrial trucks in accordance with the following consensus standards: 1.ASME/ANSI B56.1-1988-1988 Safety Standard for Powered Industrial Trucks, 2.ASME/ANSI B56.1a-1989 Addenda, and 3.ASME B56.1-1993 Safety Standard for Low Lift and High Lift Trucks. Abatement Note: Abatement certification and documentation are required for this item (See enclosed "Sample Abatement-Certification Letter").
