Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a.)Employees were exposed, while hydro-blasting the hull of the vessel USS Stephen Foster, to the hazard of a high pressure (40,000 psi) water stream. One employee was required to hold a sheet metal shield to guard against overspray while another employee power washed the hull. This was a recognized hazard inasmuch as the manufacturer of the waterjet equipment, in its manuals and video, repeatedly warns against pointing the nozzle at others, and calls for a minimum separation of twelve feet between employees. Abatement: Among other feasible abatement methods, a clamp or other mechanical device could have been used to hold the shield in place to guard against overspray from the waterjet operation.
