Section 5(a)(1) of the Occupation Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which was free from
recognized hazards
which were likely to cause death or serious physical harm to employees in
that on or about
April 13, 1998, and at times prior thereto, employees were exposed to
crushing injuries
where unstable loads were not secured to forklifts.
Among other means one feasible and acceptable abatement method would be to
follow the
forklift's safety/manufacturer's manual where it states the requirement to
tether or tie
unstable loads.
