Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the following conditions:
(a)On August 05,1998 an employee operating a Hyster forklift model #
E35XL was fatally injured while attempting to jump from the moving
machinery as it was tipping over.  Failure to use the operator's restraint
system cause the employee to become pinned between the truck and the
ground which crushed him to death.
Among, other methods, feasible and acceptable abatement methods to correct
this
hazard is to establish and enforce an adequate safety restraint system
procedure.
Essential elements of a safety restraint system procedure would be:
1)Provide seat belts.
2)Always buckle up the seat belts.
3)If the forklift starts to tip over, don't jump from it.
4)Stay in your seat, grip the wheel, brace your feet and tilt with the
forklift.
