Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being thrown from the back of a moving vehicle:
6200 Blackhorse Pike, Mays Landing, NJ 08330 -
On June 26, 1997 a group of employees were riding in the back of a pickup
truck when it was
struck by a bus. The employees were thrown from the back of the truck onto
the ground. The
employees suffered a variety of injuries with one having a severe head
trauma.
ABATEMENT NOTE: In Accordance with 29 CFR 1903.19, Abatement Verification,
the employer will furnish certification that the described hazard has been
abated. Documentation may include but is not limited to photographs,
videos,
work orders, invoices, training records and consultant reports. Abatement
documentation must be received by the Area Director within 13 calendar days
of the final abatement date for this violation.
NOTE: One feasible means of abatement would be to not allow employees to
ride in the back
of vehicles when it is not necessary for the perfromance of their job
duties. Require employees
to either walk or use buses provided by the owner of the property.
