Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to an employee in that the employee was exposed to the hazard of falling from and/or being crushed while operating a fork lift: a) Kast Distributors Inc., 300 Fow Ave., Swedesboro, N.J. - Employee was exposed to the hazard of falling from and/or being crushed by the Komatsu fork lift, Model # FB25SH-4, Serial # 030971A, that he was operating. The employee was not required to wear the seat belt while operating a power industrial truck (cargo handling equipment). The employee was exposed to serious injury and recognized hazards should the equipment tip over. The requirement for wearing a seat belt is referenced in the concensus standard, ASME/ANSI B56.1d - 1992 Addenda to ASME/ANSI B56.1 - 1988, "Safety Standard for Low Lift and High Lift Trucks", section 5.3.19, page 10.1, which states, " an active operator protective device or system, when provided, shall be used". In addition, the fork lift truck manufacturer, Komatsu, has a warning on page 15 of the Operating Manual which states that the seat belt be correctly fastened prior to operation. On or about 04/20/98. ABATEMENT NOTE: In Accordance with 29 CFR 1903.19, Abatement Verification, the employer will furnish certification that the described hazard has been abated. Documentation may include but is not limited to photographs, videos, work orders, invoices, training records and consultant reports. Abatement documentation must be received by the Area Director within 13 calendar days of the final abatement date for this violation.
