Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to a fall hazard:
a) West Quad Academic Building, Richard Stockton State College, Pomona, NJ
08240 -
An employee was lowered into a trench by riding in the bucket of an
excavating machine. The
employee was exposed to a fall of up to approximately 15' and a crushing
hazard. On or about
07/24/98.
NOTE: Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to not allow employees to ride the bucket of an excavator for
any reason.
ABATEMENT NOTE: In Accordance with 29 CFR 1903.19, Abatement Verification,
the employer will furnish certification that the described hazard has been
abated. Documentation may include but is not limited to photographs,
videos,
work orders, invoices, training records and consultant reports. Abatement
documentation must be received by the Area Director within 13 calendar days
of the final abatement date for this violation.
