Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to inorganic mercury vapors during the calibration of
pipettes:
a)  Mercury Test Room and "Clean Room" - The work area including, but not
limited
to floors, tables, and work surfaces was not maintained free of mercury
contamination.
On or about 3/31/99.
AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT
METHODS TO CORRECT THIS HAZARD ARE:
1)  Thorough cleaning of the areas with "HgX" or a similar product,
removal of all
wooden and other porous materials from the Mercury Test Room, covering all
containers
of contaminated glassware, total segregation of the clean area from the
contaminated
area, installing a door between the two rooms, proper storage and disposal
of
contaminated personal protective equipment (such as Tyvek smocks and foot
coverings),
and enhanced training with regard to end of day and spill clean up
procedures.
2)  Periodic monitoring of the Mercury Test Room and Clean Room using wipe
samples
and/or mercury detection devices such as the Jerome Mercury Analyzer to
evaluate the
effectiveness of housekeeping procedures.
ABATEMENT NOTE: In accordance with 29 CFR 1903.19 Abatement Verification,
the
employer will provide abatement certification to the Area Director within
13 calendar days of
the final abatement date for this violation.  The employer must provide
written proof that the
existing housekeeping procedures have been improved and implemented.  The
employer must
also provide sampling results (wipe sample or "mercury sniffer") which
verify
that the newly
implemented procedures are effective.
