Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious harm to employees in
that, on or about
July 20, 1998, employees were exposed to a fall hazard while working from
an elevated
work platform painting the facia boards on a two story apartment building.
The work
platform, elevated to a height of 10 feet on the forks of a Champ CB40
forklift had not been
designed so that the forks could be positioned so as to pick up the
platform in a stable and
secure position.  The 8 foot wide by 40 inch deep platform was constructed
with one railing
30 inches high on three sides.  No other means of fall protection was
provided.
Among other methods feasible and acceptable abatement methods to correct
this hazard are
(1) Provide employees with the proper fall protection when working at
elevations in excess of
6 feet above lower levels, (2) Utilize an elevated platform built and
designed as described in
ANSI B56.1-1993.
